Jammu: The Jammu & Kashmir HC on Tuesday issued notices to the defence ministry and the IAF in response to a petition filed by a woman pilot, alleging sexual harassment by her flight commander and bias by the internal complaints committee that conducted an inquiry. Justice Sanjeev Kumar has sought a response from both within four weeks. The counsel for the woman pilot submitted during the hearing that the accused repeatedly made sexual advances against her made objectionable remarks and touched her inappropriately. The petitioner also raised a legal issue regarding the applicability of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, to the armed forces.
She objected to the manner in which the internal complaints committee conducted the proceedings after she filed a complaint against the accused. Justice Kumar stayed the inquiry proceedings. Assistant solicitor general Vishal Sharma accepted the notice on behalf of the Union government.
